Tompkins Tennis Privacy Policy

The following privacy policy applies to personal data collected at www.tompkinssport.com and data collected through the tennis and fitness programs that Tompkins Tennis provides. Tompkins Tennis is committed to protecting the privacy of its users. Because Tompkins Tennis gathers certain types of information about the users or of its Services, we believe you should fully understand the terms and conditions surrounding the use of the information we collect. The following discloses our information gathering and dissemination practices for the Services. Please review the following statement to understand how the information you provide to Tompkins Tennis through the Services will be treated. 

 

1. Information Tompkins Tennis Collects

When you register, we may require certain personal information, including, but not limited to, contact information, such as your name, city and state, phone number, e-mail address, age of child participating in program along with credit card information. This information better enables us to provide you with the desired Services, content relevant to your interests and provides with aggregate data that Tompkins Tennis uses to improve the Services. 

The personal information you supply to Tompkins Tennis will not be given, sold, rented, loaned or otherwise disclosed to third parties outside of Tompkins Tennis and its agents, except when we have your permission or under special circumstances, such as when we believe in good faith that disclosure is reasonably necessary to (i) comply with legal process, (ii) enforce the Terms of Use, (iii) respond to claims that any content provided by using the Services violates the rights of third parties, or (iv) protect the rights, property, or personal safety of Tompkins Tennis, its users, or the the public. 

Our website uses Google Analytics to track the volume and type of traffic that comes to the website. When you access the site, Google may collect such information as cookies, IP address, sessions, browser type, location, page views, and number of visits. The information Google collects is not personally identifiable and is subject to Google's Privacy Policy. 

 

2. Children's Privacy

 

Tompkins Tennis does not knowingly collect any information from children under the age of 13 unless and until, as applicable according to the service, a parent, guardian or other authorized adult, or a school or education institution has provided appropriate and consent and authorization for a student under 13 to use the services. Please contact us at sandy@tompkinssport.com if you believe we have inadvertently collected personal information from a child under 13 without proper consents so that we may delete such information as soon as possible. Tompkins Tennis junior programs are available to students from ages of 4-18 with parent/guardian consent. As stated above, we do not knowingly permit anyone under 13 years of age to provide us with personal information without obtaining a parent's or guardian's verifiable consent except where:

-the sole purpose of collecting the name or online contact information of a parent or child is to provide notice and obtain parental consent; -the purpose of collecting a parent's online contact information is to provide voluntary notice to, and subsequently update the parent about, the child's participation in our Services that do not otherwise collect, use , or disclose children's personal information; -the sole purpose of collecting online contact information from a child is to respond directly on a one-time basis to a specific request from the child, and where such information is not used to re-contact the child or for any other purpose, is not disclosed, and is deleted by us promptly after responding to the child's request; -the purpose of collecting a child's and a parent's online contact information is to respond directly more than once to the child's specific request, and where such information is not used for any other purpose, disclosed, or combined with any other information collected from the child; -the purpose of collecting a child's and a parent's name and online contact information, is to protect the safety of a child, and where such information is not used or disclosed for any purpose unrelated to the child's safety; -otherwise permitted or required by law. If we receive the verifiable consent of a child's parent or guardian to collect, use and/or disclose the child's information, we will only collect, use and disclose the information as describe in this privacy statement. 

 

3. Parental/Guardian Rights

4. Your California Privacy Rights

Pursuant to California Civil Code Section 1798.83, if you are a California resident, you have the right to request information about how we share certain categories of personal information with third parties. California law gives you the right to send us a request to receive the following information: (i) the categories of information we disclosed to third parties for their direct marketing purposes during the preceding calendar year; (ii) the names and addresses of the third parties that received that information; and (iii) that the nature of the third party's business cannot be determined from their name, examples of the products or services marketed. We may provide this information in a standard format that is not specific to you . The designated email address for these requests is sandy@tompkinssport.com. You must include the statement "Your CA Privacy Rights Request" in the subject field of the email. You may also write to us at the mailing address listed in the following section. Please note that we are only required to respond to one request per user per year.

Tompkins Tennis Policies

No refunds and no cancellations for our classes.

Tompkins Tennis may modify these policies at any time and require parent(s)/guardian(s) to acknowledge and agree to such changes; such changes will be binding on both parent and student. Continued participation by the Student(s) following notice of changes by Tompkins Tennis shall be deemed acceptance of those changes.

"You" and "Your" refers to the parent(s)/guardian(s) who register the student into our program. "Student" refers to the student or students enrolled by "You." The terms "we," "us", and "our" refer to Tompkins Tennis. 

Name/Likeness Permission. You agree that Tompkins Tennis has the right to record and use your Student(s)'s image or likeness, and voice, in but not limited to photographs, videos, press releases, print advertisements, websites, brochures, and any other collateral materials without financial compensation for an unlimited period of time. Please contact sandy@tompkinssport.com if you have any questions or wish to revoke your consent for future marketing/promotional purposes.

Conduct. Tompkins Tennis reserves the right to dismiss any Student(s) for unsatisfactory conduct at any of our teaching facilities. Tompkins Tennis retains the right to terminate enrollment if the Student(s) or you do not comply with policies, rules or regulations of Tompkins Tennis. Tompkins Tennis may also terminate enrollment if Student(s) or you fail to cooperate with instructors and administration. 

 

Assumption of Risk and Indemnification. As also outlined in the parental consent form, you acknowledge and agree on your and the Student(s) behalf to (i) assume risk and financial responsibility of participating in our tennis and fitness programs and (ii) indemnify and hold Tompkins Tennis harmless and release Tompkins Tennis from any and all liability for any injury which may be suffered by Student(s) arising out of or in any way connected with participation in our classes and use of our facilities and equipment. 

Fees and Payment. Tompkins Tennis follows six week tuition cycles during the school year with the exception of Fall Session 4 and Spring Session 5 which run according to six week sessions. Once enrolled we automatically re-register throughout the school year. During the summer months we offer weekly morning camps in addition to two four week evening/Saturday sessions. Student(s) are not registered for either classes or camps until tuition is paid in full.

 

Payment Options. The Bounx Sport App is now used for all payments except private lessons which are paid through credit card . For those who attend our year-round classes, tuition will be processed two weeks prior to start of new session. During the summer, camp fees are charged prior to start date of weekly camp and/or evening/Saturday monthly option. Client is responsible for ensuring card on file is not expired and transaction is not denied. Delay in processing payment due to expired card or denied transaction may lead to late fees being charged. Tuition is considered late if payment is made after the due date which is first day of each session cycle. Late fee of 10% per month (compounded) will be charged for late payments, but shall not exceed the maximum permitted by law.

 

Missed Classes/Makeup Requests . Once registered for our program you will download the "Bounx App" from App Store. This system is used for you to check any class cancellations due to rain and also schedule one allotted makeup per month. Please notify us about missing classes at least 24 hours prior to scheduled class time and secure a makeup credit. Classes missed without notification are not eligible for a makeup class. It is also very important to cancel class at least 24 hours in advance so that your spot can become available for others to use. 

 

Rain Deductions. On rain days please check your Bounx App for class cancellation notification. Rain days are auto-deducted from next session's tuition. In the event Student is not re-enrolling in program then a makeup needs to be scheduled. Vacation Notice. If vacation notice is provided 30 days in advance then missed clinics will be deducted from tuition. However, if less than 30 days notice is given then makeups can be scheduled through Bounx App. Email vacation notice to: sandy@tompkinssport.com

 

Holidays. Tompkins Tennis closes the academy three days per year including: Thanksgiving, Christmas, and New Years Days. Clinics are held on all other holidays except the aforementioned. Termination of Enrollment. Parent must email termination notice two weeks prior to new session or tuition will be charged for upcoming session. Email termination notice to: sandy@tompkinssport.com. In the email please note student name and location where attending classes.
